Judge to rule in a month on Hans Reiser in wife's murder
A judge in Oakland says she will rule in a month on whether a computer engineer Hans Reiser should stand trial for the murder of his wife, who remains missing.
A judge will not require Hans Reiser's 7-year-old son to return from Russia to give further testimony in his father's preliminary hearing on charges that he murdered his wife Nina Reiser.
The boy and his 5-year-old sister went to St. Petersburg, Russia, to spend the holidays with their grandmother Irina Sharanova on Dec. 23 and were scheduled to return on Jan. 14.
Sharanova, who is Nina Reiser's mother, had permission from an Alameda County family court judge to take the children. She now may be attempting to get custody of them, attorneys said.
County Superior Court Judge Julie Conger ordered both sides to return to court on Feb. 23, at which time she will determine if there is enough evidence to hold a murder trial.
Prosecutor Greg Dolge said he learned Monday that the boy would not be in court for a scheduled appearance Tuesday. An attorney in Russia sent an e-mail informing him that the boy is under the care of a therapist in Russia for stress stemming from his mother's apparent death and the therapist wants him to stay in Russia for further treatment.
